For years, Palm Springs has been as a favorite destination for Gay and Lesbians. Known for its 350 days of sunshine, stunning scenery and pristine desert air, Palm Springs is a place to relax during the day and party at night.

Lounging by the pool and soaking up the sun is always a favorite pastime. If you want to get outdoors and enjoy the beautiful climate, there are plenty of activities. Soar to the top of Mount San Jacinto on the world famous Palm Springs Ariel Tramway, hike scenic trails and maze through the ancient palm groves in the Indian Canyons, or take a 4×4 tour of Joshua National Park or the San Andreas Fault.

If you are looking to take it easy, walk the infamous Palm Canyon Drive and shop mid-century boutiques and art galleries or take of tour celebrity and mid-century modern homes. Palm Springs nightlife heats up after sunset. Palm Springs is home to numerous world-renowned gay and lesbian events including Dinah Shore Weekend held every April, and the White Party, one of the largest gay circuit events in the U.S. The annual gay and lesbian film festival, Cinema Diverse, showcases the best in GLBT filmmaking annually in July, and in November, the Palm Springs Pride Festival attracts thousands the first weekend, and is quickly followed by Leather Pride, which Turns Up The Heat in Palm Springs the second week of November.

Lowdown on Gay Rights

NO Licenses marriages for same-sex couples

On Nov. 4, 2008, California voters approved Proposition 8,    which amends the state constitution to prohibit marriage by    same-sex couples. The amendment overrules a May 2008    decision by the California Supreme Court recognizing     marriage equality. The more than 18,000 same-sex couples    married between June 17 and November 4, 2008 in California   will remain valid. 

NO Honors marriages of same-sex couples from other jurisdictions

YES Relationship recognition for same-sex couples

      California continues to provide rights and responsibilities to registered domestic partners. Same-sex couples and different-sex couples over the age of 62 are eligible to register and receive essentially all of the rights and benefits of married couples under state law.

Statewide Hate Crimes Laws:

YES Protection based on Sexual Orientation

YES Protection based on Gender Identity 

California hate crimes law directly addresses violence based on sexual orientation. Cal Pen Cod §  422.75 (2001). 

The California hate crimes statute defines "gender" as "the victim’s actual sex or the defendant’s perception of the victim’s sex, and includes the defendant’s perception of the victim’s identity, appearance, or behavior, whether or not that identity, appearance, or behavior is different from that traditionally associated with the victim’s sex at birth." Cal Pen Code § 422.76 (2001).   

Statewide Sodomy Laws 

The California sodomy law was repealed in 1976. 

Statewide Non-Discrimination Laws 

YES Sexual Orientation Protection

      California law prohibits discrimination based on sexual orientation in the areas of employment (public and private), housing, and public accommodations. Cal Gov Code § 12920 (2001); Cal Civ Code § 51 (2001); see also AB 14, Civil Rights Act of 2007. 

YES Gender Identity Protection

      California law explicitly prohibits discrimination based on gender identity, appearance and behavior in the areas of employment (public and private), housing, and public accommodations. Furthermore, California law permits employees to dress consistently with their gender identity. Cal Gov Code § 12926 and §12949 (2003); see also AB 14, Civil Rights Act of 2007.

Statewide Healthcare 

On October 14th, 2001 Governor Gray Davis signed a bill that enhanced the state’s domestic partner law by extending benefits to registered domestic partners. The enhanced law improves sick leave benefits, disability benefits and expanded employer sponsored health care coverage. California specifically provides domestic partners the same authority to make medical decision on behalf of an incapacitated partner as a spouse has with regard to an incapacitated spouse. § 4716. Domestic partners and their children are specifically granted visitation rights under CAL. HEALTH & SAFETY. CODE § 1261.  

Statewide Employment Protections 

YES Private employment protections based on sexual orientation.

YES Private employment protections based on gender identity.

YES Public (state) employment protections based on sexual orientation.

YES Public (state) employment protections based on gender identity. 

Statewide Parenting Laws 

Who May Adopt:  California law states that an adult related to the      child, a person named in a deceased parent’s      will, a legal guardian, or a person with whom the      child has been placed for adoption is permitted      to petition to adopt. CAL. FAM. CODE § 8802. 

Same Sex Couples: California law permits same-sex couples to jointly      petition for adoption.

Notes:    In 2003, the state Supreme Court affirmed that a      same-sex co-parent can petition to adopt his or      her partner’s child or child of the relationship.      (Sharon S. v. Superior Court, 73 P.3d 554 (Cal.      2003)) Registered domestic partners can use the      state’s stepparent adoption laws to adopt each      other’s children or children of the relationship.

(CAL. FAM. CODE § 9000(b))

California state regulations do not address       whether sexual orientation is a considered factor      in adoption decisions.
